Candidate visit

One of the presidential candidates was in East Boston on Saturday. No, not Clinton or Obama; and not McCain or Huckabee. You're not getting any warmer, so I'll tell you: RĂ³ger Calero, the candidate of the Socialist Workers Party.

As the Bay State Banner points out in a story on the candidate, not only is Calero extremely unlikely to get more than several thousand votes, but even if he were to miraculously win he couldn't serve. He was born in Nicaragua, and the Constitution requires that a president be "a natural born Citizen."

And maybe this is the time to bring up an interesting point: Republican candidate John McCain was born on Aug. 29, 1936, in the Panama Canal Zone, which was controlled at the time by the United States. Are we sure that Sen. McCain falls within the Constitution's guidelines?

By the way Jim, how many wars did you fight for America? How many years were you a P.O.W? Even if that was the case(McCain was born out of this country) better him serve, who gave his life than someone like you who bashes America. You should thank God that you can bash and not go to jail.

You can be a natural born citizen even if you are not born in USA, as long that one of your parents is an American citizen. So....... no case here.

None, and none. And you? I never said that McCain wasn't a war hero. He is. I'm sure he is tougher, stronger and gutsier than I'll ever be. Does that mean I am not allowed to voice my opinion?

I was simply quoting the Constitution and wondering about what that particular phrase means and if it precludes McCain from serving as president.

To my knowledge, that has never been sorted out by the courts in the context of the presidency.

Jim: How far do think we'd get with this Supreme Court if we asked them to weight in on McCain's citizen status as it applies to the presidency? Not very far, I'd venture to guess.

I agree. I'm sure the Supreme Court would not want to touch this issue, and if it reached them via a lower court decision that overturned McCain's election (if you can even imagine that) then the Court would likely reverse that.

Imagine the court system delegitimizing the selection of the people! It'd be a Constitutional crisis beyond the scale of 2000's Bush v. Gore.

Just admit it, you don't pay much taxes because you can't make much and you despise anyone who is sucessful.
People that grew up with you are embarrassed by you trust me. Didn't you grow up in the Salesian's Boys Club? where priests and brothers of your faith thought you good? what happened?

Historically, the courts have left it up to Congress to devise the rules and regulations regarding citizenship status. It's a fascinating history actually.

In general Congress will recognize some births occurring outside the US depending on the who the father is and where the birth occurred. My oldest sister was born to a US citizen on a military base in Panama. Our mother was not a US citizen and this happened during a period in which the rules were changing around who could be given US citizenship under these circumstances. The same for me. I was born in the US, but at a time in which there was a rule that if the mother was not a citizen then the child was not a citizen unless born under specific circumstances. These rules change with some regularity so it all depends on when the child is born, what the different deadlines are, and whether citizenship will be based on the father or the mother. With some help from the Air Force, I was able resolve the question about my citizenship (yes I am a citizen). I have no idea how my sister did it but she has been able to prove her citizenship status as well. Depending on a whole lot of circumstances, me and my five sisters may have been "illegal" all those years.

In McCain's case, under the laws that existed at the time and even now, it would likely be pretty cut and dry in that (I am assuming) both parents are US citizens and he was born on a US military base.

There have been times in which he law was that children born to citizen mothers and non-citizen fathers would not be given citizenship. Other times it would be the reverse, especially if the birth happened overseas. The US government was quite complicit for many years in helping US soldiers who father children while overseas evade responsibility for those children. Again, the laws have changed so that those children are able to get the benefits and security allowed under US law. They don't automatically get to become citizens, by the way. It has mostly to do with inheritance and social security rights.

There was also a period of 15 years in which citizen women who married non-citizen men were stripped of their citizenship (1907-1922). You might notice that this was long after the ratification of the 14th Amendment (establishing birthright citizenship). But since the Court's have never intervened on Congress's authority on this matter, they were no protection against this law. You might also notice that the law changed less than 2 years after the passage of the 19th Amendment (women's suffrage).

Hey listen anonymous, even if you think Jimbo is a lefty liberal, that does not mean he cant have a point of view - as you have yours. Besides, if we all thought alike, what fun would it be to come on here and exchange our opinions and try to make people see it our way? There would be no point. One thing is for sure, your tactics do not persuade me that your points are any better -especially when you bash people like Jimbo, who I may not agree with all (most) of the time but who posts in a respectful manner.

Lets keep the hostility and personal attacks to a minimuum - there is really no need for it here - it just becomes a bunch of noise. Good luck with your anti-Jimbo blog...I wont be visiting.

In my opinion this should be visted because its a very serious issue.

That was not American Soil,it was occupied soil,as is Iraq.

Our country is in desperate need of over hauling its election process.

Each state has their own rules,most have very different machines,and the Texas 2 Step is a joke.

What we need is a One (1) system voting regulation that is the exact same in every single city,county,and state,along with the exact same machines.

Then we should exorsist the Super Delegate system,and under NO CONDITIONS should any thing more than the actual total vote of the populous count.

Without a huge over haul,we will continue to be a joke.

Now to the word Libral,or far Left,or far Right.

By the way, I have been volunteering at soup kitchens in Malden and Everett, and I get the impression that some of those who I serve are veterans.
